The Receiver has been advised by the Clerk for Judge Cotton that the ex parte hearing set for tomorrow morning at 8:30 a.m. in Department A of the Van Nuys Court is off calendar and will not occur tomorrow. Therefore, please do not go to the court. The Judge has signed the order granting the ex parte relief requested, including but not limited to the approval of the Board of Directors elected by the membership on July 28, 2020, and the turnover of possession and control of the Association and its assets by the Receiver to the newly elected Board. When the signed order is received from the Court, it will be circulated to the membership and posted at the Association.

On August 24, 2020, the Court filed an order approving the Stipulation to Cancel, or in the alternative, Continue Status Conference Hearing. The Court ordered that the status conference hearing, currently scheduled for August 27, 2020, at 8:30 a.m., has been continued to November 12, 2020, at 8:30 a.m., in Department A, located at the Superior Court of California, County of Los Angeles, Van Nuys Courthouse East 6230 Sylmar Ave., Van Nuys, California 91401.

June 19, 2019 Meeting with the Court – 2:30 p.m.

Dear HOA Members:

In preparation for the 2:30 p.m., June 19, 2019 meeting with the Court, and in accordance with the Court’s March 28, 2019 ruling, the Court has approved the agenda below based on the submission of letters and information from various individuals.

AGENDA:
a. Retention of different property manager to reduce costs;
b. The amount of the special assessment is excessive. The $1,500.00 down payment should be spread over 3 or more months;
c. What has been done to recover funds for the Association? Has a claim been submitted to the insurance company? When will the statute of limitations expire?
d. Is the LADWP bill current?
e. Roof replacement – which bid should be accepted?
f. After the special assessment is collected from each owner, what improvements will be completed?
g. Drain and close the pool. Use the extra money saved to pay for janitorial costs; and cleanliness of the property is becoming an issue. Janitorial and parking lot sweeping services should be increased.

This man broke the glass of a common area table at 12:15 p.m. on Sunday, February 10, 2019 while trying to move it into the pool area. He then went back through the pool area and used the elevator. If you know who this is, please call our office to provide information. If this is you, please turn yourself in to the Receiver. Phone: 310-207-8481. The man is wearing a Chargers football sweatshirt, has a grey beard, and glasses.

The Receiver is advised that numerous residents are allowing their dogs to wander around the property off-leash and that they are creating messes in common areas and are not picking up after their dogs. If you observe this behavior, please email the Receiver’s office immediately – pictures of the offenders are welcome. Since the cleaning crew is only servicing the property once a week, this situation is going to continue to get worse. It is shameful that certain individuals continue to allow this conduct to occur. At the next board meeting, the Receiver will be formally adopting a fine schedule. Thereafter, owners may be subject to fines. There is one individual that consistently violates this rule, even after having been sent numerous letters to cease and desist. After the fine schedule is adopted, the Receiver will vigorously pursue enforcement of this rule against this individual – as well as all others that violate this common sense policy (keep dogs on leashes and pick up after your dog).

Due to lack of funds, effective  1/22/19, the HOA’s earthquake insurance policy expired.

1/14/2019

The cash position of Tarzana Plaza is extremely dire. Approximately 30% of owners are delinquent in their HOA assessments. As a result, the HOA is unable to pay its basic monthly operating expenses. The Receiver is working on emergency funding which he hopes to receive on Wednesday, January 16, 2019. If those funds are not received, it will likely be necessary to terminate the landscape, janitorial and security services. In addition, it may not be possible to maintain earthquake insurance on the building. The Receiver encourages all delinquent homeowners to pay their delinquent assessments immediately.

The Receiver has scheduled a meeting of the Tarzana Plaza Condominiums Association on January 15, 2019 as set forth above to assist you in understanding the reasons for amending and restating the Covenants Conditions and Restrictions (“CC&Rs”), and the Bylaws of Tarzana Plaza Condominiums Association, and to answer any questions.  In the near future you will receive a letter from the Receiver’s counsel, Loewenthal, Hillshafer & Carter, LLP, enclosing a copy of the proposed amended and restated CC&Rs and Bylaws for your information and review.

Please plan to attend the meeting on January 15, 2019 if you have any questions concerning the proposed new CC&Rs.

Due to an emergency, the water to the building may be shut off between 9:00 a.m. and 3:00 p.m. on Tuesday, August 21, 2018.  We apologize for any inconvenience that this might cause, but to prevent damage to the building, repairs must take place immediately.

SPA MOTOR UPDATE: The spa motor and pump needs to be replaced. This work has been scheduled for Monday, July 16th. The pool maintenance company will be by today or tomorrow morning to shut off the motor until Monday. Therefore, please avoid using the spa until further notice. Hopefully, the spa will be functioning normal and ready for use by Tuesday of next week.

POOL/SPA UPDATE: Our pool company is aware of the problem and will be sending someone out today to address the issue. We will have a report back from them tomorrow morning.

Regarding the recent hot water/lack of water problem – a leak in a 2 inch line was discovered and repaired. The plumber advises that the plumbing systems, especially the hot water boiler, are in poor condition. A bid for major repair/replacement of the boiler and associated plumbing lines is being obtained. The HOA previously obtained a bid from another plumber and the Receiver is comparing this bid with a new bid. The cost will likely be very high. This process will likely take months to resolve and in the meantime, repairs will be made on an as-needed basis. The source of payment will be in the form of a special assessment or loan to the HOA.

Overall, the HOA is in dire financial condition. There are virtually no reserves (less than $1,000.00) and the current cash in the operating account is less than the bills on hand. A payment plan was recently arranged with the utility company just to keep the electricity on in the building. Legal fees, expenses and lack of proper reserves have contributed to the current situation.

Bids for the replacement of the roof are being obtained. A recent inspection by a roofing consultant confirmed that the roof needs to be replaced – however, not in the areas where recent work was completed. The source of payment will be in the form of a special assessment or loan to the HOA.

The mold situation in the clubhouse as well as in some units will/have been investigated. The source of payment will be in the form of a special assessment or loan to the HOA.

Many owners have complained about the condition of awnings. This matter will be investigated. The source of payment will be in the form of a special assessment or loan to the HOA.

The numerous law suits filed in connection with the property/HOA continue to be investigated. Settlement agreements are being pursued where possible. Legal fees paid by the HOA are also being investigated.

The former management company, J&N Realty, abruptly resigned after the Receiver requested financial reporting that is ordinary and customary. J&N refused to provide those reports and resigned. The Receiver was in negotiations with a replacement management company and without warning, they declined to take on the assignment. This HOA has a very bad reputation for many reasons, including the fact that the HOA and the HOA management company have been sued. As of July 2018, all management functions of the HOA are being performed by the Receiver’s office. The Receiver and his company have decades of experience in managing commercial and residential property. During the transition from J&N to the Receiver’s office, there may be some periods of inconvenience due to paperwork/contract issues.  The Receiver continues to work to minimize any disruption.

Beginning during the second week of July 2018, the Receiver’s employees will begin performing cleaning to the property. The former landscaping/cleaning crew was not retained by the Receiver due to insurance concerns. If there are any concerns regarding cleaning, please do not interact directly with the individuals doing the work; rather, please email concerns to Tarzanahoa@fedreceiver.com .

Bids for a new landscape company will be obtained in July 2018.

The Receiver is working on his Initial Receiver’s Report. A copy of the Report will be filed with the Court and a copy will be posted on this website.

All owners should be prepared for a Dues Increase/Special Assessment or both. This will likely occur during the 3rd quarter of 2018. It will be subject to court order and after an HOA Board meeting is held. The Receiver is the only member of the HOA Board of Directors. All former board members have resigned.

UPDATE: As of 2:30 pm on July 6, 2018: The plumber found an existing 2” cold water inlet to the boiler that was leaking. They installed a temporary clamp and will require about 3 hours of work to make the repairs.

The Receiver is aware of and is working on the hot water heater issue.
